San Antonio appeals court affirms denial of request to temporarily enjoin SAISD vaccine mandate

Last month, the Fourth Court of Appeals affirmed a trial court's denial of the State of Texas's request to temporarily enjoin the San Antonio Independent School District's vaccine mandate. In September 2021, the State sued the SAISD and its superintendent for a declaratory judgment regarding the SAISD's policy requiring that all its employees be vaccinated for COVID-19. The unanimous panel held that the State failed to show a probable right to relief at the temporary injunction hearing. The 4th Court addressed the scope of executive authority to preempt local laws.
